IMPORTANT BUT UNEXCITING

Isabella Oliver's website, products and related services are made available to you subject to the following Terms and Conditions (Ts &Cs) and any other rules posted on the website. By visiting IsabellaOliver.com, you are accepting and consenting to the practices described.

From time to time, we may modify the Ts & Cs, and your continued use of IsabellaOliver.com following such change will signify your agreement to be bound by the modified Ts & Cs.

People wishing to use IsabellaOliver.com must read and agree to be bound by our policies. In particular, we draw you attention to our policies relating to the terms of purchase, order acceptance and our privacy policy.

Please note that you will only ever pay once for delivery, even if particular items in your order have to be shipped separately. All back orders will be sent standard delivery.

Please read the Ts & Cs and check back often. If you do not agree to any changes then you must immediately stop using IsabellaOliver.com.

PRICES

We cannot confirm the price of an item until your order is accepted in accordance with our order acceptance policy (see ORDERS section below).

UK and EU

Prices shown on the UK site are in GBP and are inclusive of VAT. Prices shown on the Euro site are in Euro(€) and are inclusive of EU taxes.

Please note that all shipments to destinations outside of the UK, France or EU may be subject to import duties and taxes, which are levied by the importing country at the time the shipment arrives in your country. All applicable duties, fees and any additional charges for customs clearance are your, our customer's, responsibility.

US and Rest of World

Prices shown on the US site are in USD and are exclusive of taxes. Please note, as the customer you are the Importer of Record and you may be subject to import duties and taxes, which are levied by US customs at the time the shipment arrives in your US. All applicable duties, fees and any additional charges for customs clearance are your, our customers, responsibility.

Canada

Prices shown on the Canadian site are in CA$ and are exclusive of sales tax. Please note all orders are delivered duty paid (DDP). All applicable duties, fees and any additional charges for customs clearance are covered by Isabella Oliver.

SALES & PROMOTIONS

Please note that promotions and sales are not valid together. Only one promotion can be used in a single order. Gift voucher are excluded from offers.

Promotional discounts shown online apply only to full price products. The discount offered from the promotional code will be applied at checkout after the code has been entered.

Sale reductions are already reflected on prices listed on the website.

Items bought during a sale period/at a discounted price can only be returned within 7 days of receipt.

Offers and promotion codes are only valid on Isabella Oliver branded products. For a full list of exclusions please see our Promotions Conditions page.

ORDERS

All orders are subject to acceptance and availability. Orders placed by you are an offer to purchase and will be accepted by us, subject to stock availability.

Please note that for inventory purposes each item requested constitutes an individual order. Wherever possible we will attempt to consolidate multiple orders in one shipment and on one invoice. Due to inventory and packaging requirements, however, orders may be shipped over several days in multiple packages.

The steps required to create the contract between you and us are as follows:

• You confirm your order to us by pressing the confirm order button at the end of the checkout, you will receive an email acknowledging the details of your order. This email is NOT an acceptance of your order.
• As your product is shipped from our warehouse we will send you a despatch confirmation email.
• Order acceptance and the completion of the contract between you and us will take place on the dispatch to you unless we have notified you that we do not accept your order, or you have cancelled it.

The sale contract is concluded in England and the language of the contract is English.

Non-acceptance of an order may be a result of one of the following:

• The product you ordered being unavailable from stock.
• Our inability to obtain authorisation for your payment.
• The identification of a pricing or product description error.

PAYMENT

We will not charge you until the goods leave our warehouse and we will only charge you postage once per order, no matter how many parcels we send you. You confirm that the credit/debit card that is being used is yours. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to Isabella Oliver, we will not be liable for any delay or non-delivery.

LEGAL STATEMENTS ON RETURNS

We accept returns if they are unused, in a resalable condition with all tags attached, including security tag.

Please return any unwanted item(s) within 30 days of receipt (7 days for sale items). We recommend recorded post and retaining Proof of Postage as we do not accept responsibility for items lost in transit. Refunds will be made to the original payment method. Isabella Oliver will pay delivery on your first exchange (sent via Standard Delivery). Subsequent exchanges are charged at the standard delivery rate.

Please note: hosiery items must be returned unopened and in their original condition. Swimwear items, briefs and thongs: please ensure that these are tried on over your own underwear. We reserve the right to refuse returns of items where it is apparent that this has not been done. On returning goods on which you have received a discount/offer, that discount/offer will no longer apply if you fall below the discount/offer threshold

INTELLECTUAL PROPERTIES RIGHTS AND RIGHTS TO USE

You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the Website shall remain at all times vested in Isabella Oliver. You are permitted to use the Content only as expressly authorised by Isabella Oliver. Any reproduction or redistribution of the above listed Content is prohibited and may result in civil and criminal penalties. You acknowledge and agree that the material and content contained within the Website is made available for your personal, non-commercial use only. Any other use of the material and content of the Website is strictly prohibited. You agree not to (and agree not to assist or facilitate any third party to) modify, copy, reproduce, transmit, publish, display, distribute, perform, license, commercially exploit or create derivative works of such material and content.

You may not use this Site, or any of its Content, to further any commercial purpose, including any advertising or advertising revenue generation activity on your own Site.

TELL A FRIEND

By entering the email addresses of your friends you are confirming that you have obtained their consent for this. Please note, you will be stated as the person who has made the recommendation in the email to your friend. This offer only applies to the Isabella Oliver and Baukjen brands. To qualify for this offer your friend must not be on our email subscribers list or an account member of Isabella Oliver or Baukjen. The promotion code cannot be used in conjunction with any other offer. 1. This Competition is open to customers aged 18 and over only.
2. Entry into the competition is on acceptance of these Terms and Conditions. To enter the competition, you must complete the following steps: 1) Enter your first name and email address, 2) Answer the questions provided and 3) Agree to terms and conditions upon completion of this and you will receive one (1) entry into the competition.
3. One winner will receive a £1,000 shopping spree at Isabellaoliver.com and a personal online styling session. The prize is not transferable and may not be purchased, sold, bartered or otherwise exchanged for value without the prior written permission of Isabella Oliver.
4. The closing date for entries is 23.59 GMT on 19 June 2013. Entries received after the closing date will not be processed. No cash alternative will be offered.
5. The winner will be selected at random and will be notified within 5 days of the closing date of the competition by email, using the details entered on the competition form. If the selected winner cannot be contacted, or does not respond within five (5) days, such potential winner shall forfeit any and all rights to the prize and, at the discretion of Isabella Oliver, an alternate potential winner may be selected. All decisions of Isabella Oliver are final and binding in all respects.
6. The winner must claim their prize directly with Isabella Oliver (contact details will be provided to the winner), between 19th June 2013 until 18:00 GMT on 30 November 2013.
7. The prize can only be redeemed on full priced items and excludes sale items, jewellery, footwear and lingerie.
8. No responsibility is taken for entries that are lost, delayed, misdirected or incomplete or cannot be delivered or entered for any technical or other reason. Proof of delivery of the entry is not proof of receipt.
9. When submitting your competition entry, you will be required to give us your first name, email address and answer the questions provided. We will use this information to operate this competition (including checking your eligibility to enter it), but for no other purposes. We will not keep this information for longer than is necessary for the operation of the competition.
10. Isabella Oliver will only accept legitimate email addresses.
11. No purchase is required to enter the competition.
12. The Competition is not open to employees of Isabella Oliver, their family members or anyone else connected with the competition.
13. Entry into the Competition is acceptance of these Terms and Conditions.
14. Isabella Oliver accepts no responsibility for any damage, loss, liabilities, injury or disappointment incurred or suffered by you as a result of entering the Competition or accepting the prize.
15. The Promotion will be governed by English law.
16. Isabella Oliver reserves the right to cancel the competition if it is reasonable to do so or if unforeseen circumstances arise.
17. By entering this competition you are agreeing to receive regular fashion updates and news via email from Isabella Oliver. If you do not wish to receive an email communication you can unsubscribe at any time.

IMPORTANT NOTICES

Every care has been taken to describe items accurately, however slight variations may occur with colour reproduction or text descriptions, to the extent permitted by law, we do not warrant that the text descriptions, colours or other content is accurate, complete, reliable, current or error free.

We will take all reasonable care to ensure that all details, descriptions and prices on the Website are correct at the time when the relevant information was entered onto the system. We cannot confirm the price of an item until your order is accepted in accordance with our order acceptance policy (see ORDERS section above).

From time to time slight alterations may be made to the design and/or specification of our garments and fabrics to ensure that the offer optimum fit and durability.

Isabella Oliver shall not be liable for any indirect or consequential loss whether this arises from breach of duty, breach of contract, negligence or any other way. Liability for any claim shall not exceed the price of the goods supplied.

Orders are for the personal, non- commercial use of our customer. Resale of any Isabella Oliver product without the express, written consent of Isabella Oliver is strictly prohibited. Multiple orders for Isabella Oliver deemed to be commercial quantities will not be accepted. Please note, local import duties maybe payable on receipt.

All contracts are conducted in English and by entering into a contract both parties agree to submit to the sole jurisdiction of the courts of England and Wales, in accordance with English law.

All of the above does not affect your statutory rights.
